These Terms of Service ("Terms") govern your use of the Banchan - Korean Food Guide mobile application ("App") operated by Universal AI LLC ("we", "our", "us"). By using the App, you agree to these Terms.

1. Description of Service

Banchan is an AI-powered Korean food guide and learning app that helps users discover, understand, and explore Korean cuisine. The App provides dish identification via camera scanning, an AI guide (Chef Minji) for personalized recommendations and education, Korean restaurant discovery, recipe browsing, pronunciation guides, and a gamified learning experience with XP and streaks. The App is designed for informational and entertainment purposes.

2. Eligibility

You must be at least 13 years old to use Banchan. By using the App, you represent that you meet this age requirement.

3. Account

You may create an account using Sign in with Apple. You are responsible for maintaining the security of your account. You may delete your account at any time from the Settings screen within the App.

4. AI-Generated Content Disclaimer

Important: All dish identifications, ingredient lists, spice level indicators, recipe suggestions, restaurant recommendations, and Chef Minji AI responses are generated by artificial intelligence and are for informational and entertainment purposes only. They do not constitute professional dietary, nutritional, medical, or allergy advice.

You should always:

• Verify ingredient information directly with restaurant staff, especially regarding allergens
• Consult a healthcare professional for dietary or medical concerns
• Use your own judgment regarding spice levels and food sensitivities
• Not rely solely on AI-generated information for allergy-critical decisions

AI-generated content may contain inaccuracies. Results may vary between scans and interactions. Universal AI LLC is not responsible for any adverse reactions, allergic events, or health issues resulting from reliance on AI-generated food information.

5. Subscriptions & Payments

• Banchan offers a free tier with limited features and a Premium subscription with full access to all features.
• Premium subscriptions are billed through Apple's in-app purchase system.
• Premium plans available:
  • Weekly: $3.99 USD per week, no free trial.
  • Annual: $49.99 USD per year, with a 3-day free trial for new subscribers. After the trial period, the annual subscription price will be charged to your Apple ID account.
• Free trial eligibility is determined by Apple. The trial is available only to new subscribers who have not previously used a free trial for this subscription.
• You can cancel your free trial at any time before it ends through your Apple ID settings to avoid being charged.
• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen plan.
• You can manage or cancel your subscription by going to your Apple ID Account Settings after purchase.
• Any unused portion of a free trial period will be forfeited when you purchase a subscription.
• Refunds are handled by Apple according to their refund policy.

6. User Responsibilities

You agree to:

• Provide accurate information when using the App
• Use the App only for its intended purpose of exploring and learning about Korean cuisine
• Not rely on AI-generated content as a substitute for professional dietary or medical advice
• Verify allergen information independently before consuming food
• Comply with all applicable laws and regulations

You agree not to:

• Attempt to reverse-engineer, decompile, or extract source code from the App
• Use automated systems to access the App or circumvent rate limits
• Upload illegal, offensive, or harmful content
• Use the App to harass, abuse, or harm others
• Redistribute, resell, or commercially exploit any content from the App
• Misrepresent AI-generated content as professional advice

7. Intellectual Property

The App, including its design, features, code, content, recipes, educational materials, Chef Minji character, and branding, is owned by Universal AI LLC and protected by intellectual property laws. All rights are reserved. You may not copy, modify, distribute, or create derivative works based on the App or its content without our prior written consent.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Limitation of Liability

The App and all content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the accuracy of AI-generated dish identifications, ingredient lists, spice level assessments, nutritional information, or any other content. To the maximum extent permitted by law, Universal AI LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or health-related damages, arising from your use of the App.

In no event shall our total liability exceed the amount you paid for the App in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Universal AI LLC from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time by deleting it from the Settings screen. Upon termination, your right to use the App ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of significant changes through the App or by updating the effective date above.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from or relating to these Terms or the App shall be resolved in the courts of the state in which Universal AI LLC operates. You agree to submit to the personal jurisdiction of such courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
